Your Lawyers Limited, a leading consumer law firm, has won a High Court action relating to the Volkswagen AG Emissions case.

The firm succeeded, in the High Court of Justice, in removing another firm of solicitors, Harcus Sinclair from the proposed class action, paving the way for Aman Johal of Your Lawyers (Car Emissions Lawyers) to lead the case in representing the owners of diesel vehicles in their claim against Volkswagen (VW).

Harcus Sinclair, having breached an agreement and also a solicitor’s undertaking, were criticised for causing irreversible delays to the action against VW in the case. The High Court ordered the removal of Harcus Sinclair from the ‘Dieselgate’ litigation until April 2022. It was found that Harcus Sinclair had broken an agreement it gave to Your Lawyers Limited in April 2016 not to recruit their own clients to the consumer action.

The Judge, Edwin Johnson QC, held that it was imperative that Harcus Sinclair be banned from participating in the litigation until April 2022, adding that their presence had caused delays that have been to the detriment of the consumer action against VW.

Despite the findings against them, Harcus Sinclair is now remarkably appealing the decision.

Commenting on the judgment, Aman Johal of Your Lawyers Ltd said: “It is  an unfathomable decision given that Harcus Sinclair have broken an agreement, are in breach of a solicitor’s undertaking and have already caused significant delay to the underlying VW litigation. The judgment is a robust one and the decision to appeal an abject one; it will only cause further delay and disruption to the 55,000 plus current VW claimants. VW claimants and the profession expect and deserve more.”

He continued, “Dieselgate is the biggest case of fraud in automotive history. An estimated 1.2m VW diesel cars and vans are affected in the UK. VW has already pleaded guilty in the US and it’s time they came clean here. Owners of these diesel vehicles, whether bought new or second hand, may be entitled to thousands of pounds in compensation and Your Lawyers Limited will fight for every penny for the claimants’.
